As the country experienced the first ever nullification of 2019 presidential election results in the history of 26 years of democracy.
Both Drs;Lazarus McCarthy Chakwera of Malawi Congress Party and Saulos Klaus Chilima of United Transformation Movement challenged the 2019 presidential election results where Malawi Electoral Commission announced His Excellency Prof Arthur Peter Mutharika as the winner.
Both the Constitutional Court and Supreme Court found the leadership of Mec incompetent and the presidential election full of irregularities and inconsistencies that could not warrant an accurate and credible results to depict a well deserved victor.
In 2019,Malawians participated in Tripartite Elections,where they voted for a presidential,parliamentary and ward councilor candidate.
Some of the candidates in Parliamentary Election had grievances and they were asked by Mec to tender in their complaints within the first week of announcement or challenge the results at the high court.
One case study is Mangochi North East Constituency.
Whereby an independent candidate Hon.Martin Chikati Sekati is challenging the Mec results that announced Hon Idi Kalosi,a candidate for United Democratic Front Party as the legitimate winner.
Currently the case is being heard in the High Court of Malawi in Blantyre.
Judgement was initially slated for the 13th March 2020 but was postponed until next week on 08th June 2020.
The case is attended in the chambers of Hon Judge Joseph Chigona.
Hon Kalosi is being represented by Mec’s lawyers from Mbeta and Company,he had three witnesses.
Whereas,Hon Sekati is being represented by lawyer SC Chimwenwe Kalua of Golden Law Partners and he had 5 witnesses.
Hon.Sekati arguements were;
1) Several irregularities in terms of tippexed results, number of registered voters at pollin stations were totally different from casted votes.
2) Out of 18 polling stations,only results from 5 polling stations were calculated and used to announce the winner.
